Q. I am considering filing for divorce, how long would I have to wait before the divorce is final?
A. By statute, you cannot get officially divorced earlier than 120 days from the date the action is filed. (Wisconsin Statute Section 767.335) The one exception to the general 120 day rule is in cases of "emergency". Emergency typically means necessary for the protection of the health or safety of either party or any children involved in the action. Most Wisconsin Courts will only grant emergency divorces under extreme circumstances.
